Abstract: Non-person identity consists of providing unique, stable identifiers to Digital Assistants, AI Bots and Software Based Agents. AI Bots, as a term, is already outdated. AI itself has been reclassified as either generative or agentic. If we characterize agentic AI as just another application, consider it is an application that can take increasingly autonomous actions. Or at least ones that a human may not have intended. Society, when it catches up to this, will expect non-repudiation for those actions taken by an AI agent which immediately means a reliable identifier or identity. There will also be an expectation that the person who set the agent on its course by using it and/or manipulating it can be identified and held responsible. We will explore whether Agentic AI may bring about the tightest coupling yet between the CISO and Corporate Counsel. We will examine that there is no real plan B in society’s legal system if concepts of agency, intent and liability cannot be cleanly assigned to humans. And you will marvel that virtually no one is talking about this …. Yet.
